Report #9503

[agent\_craft] Agent generates legal documents or interprets statutes for user's specific situation

Never generate, customize, or interpret legal documents \(contracts, wills, complaints, motions\) for a user's specific circumstances. Provide only general legal information with prominent disclaimers. If a user asks 'Can I sue my landlord for X?' or 'What does this clause in my contract mean?', respond with general information and recommend consulting a licensed attorney in their jurisdiction.

Journey Context:
The distinction between legal information and legal advice is the most critical boundary in UPL law. Legal information is objective, general, and applies broadly \('In most states, landlords must provide habitable housing'\). Legal advice is subjective, specific, and applies to the user's situation \('Based on what you described, you have a strong case'\). ABA Model Rule 5.5 and state bar opinions consistently hold that applying law to specific facts constitutes the practice of law. Even well-intentioned responses that interpret a user's specific situation cross this line. The risk isn't just regulatory—users may rely on incorrect or incomplete analysis to their detriment, creating liability. The safe pattern: provide general legal information, cite sources, and always recommend attorney consultation for specific matters.
