[agent\_craft] Chatbot financial responses aren't regulated communications like marketing materials
Treat all agent-generated financial content as a regulated communication subject to the same rules as marketing materials. Implement content classification to flag responses touching on securities, investments, or financial recommendations. Apply FINRA communication standards: pre-approval for institutional communications, retention of all interactive communications, and principal review where applicable.

FINRA has explicitly stated that digital communications including chatbots and AI-generated content are subject to the same supervision rules as other public communications. Regulatory Notice 11-39 established that interactive electronic communications on social media must be supervised. Regulatory Notice 17-18 extended this guidance. The SEC has brought enforcement actions against broker-dealers for failing to supervise digital communications \(e.g., the 2022 wave of $1.1B\+ in fines for off-channel communications\). An AI agent's real-time responses are not exempt from these requirements simply because they're generated algorithmically. If your agent touches financial topics and your org is a registered firm, every response is a supervised communication.
