Implement jurisdiction detection and apply the most restrictive applicable state's UPL standards. Pay special attention to Texas \(broadest UPL definition including document preparation\), Florida \(most active UPL enforcement committee\), and New York \(criminal penalties under Judiciary Law §478\). Default to the strictest standard when jurisdiction is unknown.

The ABA Model Rules are a model, not law. Each state adopts its own version, and some are significantly broader. Texas Government Code §81.101 defines law practice so broadly that filling in legal forms can constitute UPL. Florida's UPL committee issues advisory opinions aggressively and has pursued enforcement against non-lawyer services. New York's Judiciary Law §478 makes UPL a criminal misdemeanor. California's Business & Professions Code §6125-6126 also carries criminal penalties. An agent serving US users without jurisdiction detection is effectively choosing to comply with the least restrictive state—which is the wrong direction. The safe default is the most restrictive applicable jurisdiction.
