Report #81612
[agent\_craft] Generating specific tax advice or recommending tax positions to a user
Prefix any tax-related code or text generation with a strict disclaimer stating it is for informational purposes only and is not intended to be, and should not be construed as, tax advice. Avoid writing code that directly implements a specific tax avoidance strategy without flagging it.
Journey Context:
Agents often write scripts calculating tax liabilities or optimizing deductions. Under IRS Circular 230, only licensed practitioners \(CPAs, tax attorneys\) can give written tax advice that a taxpayer can rely on to avoid penalties. An AI generating a script that says 'use this deduction to lower your tax bill' crosses into unlicensed tax practice. The tradeoff is between being helpful and exposing the user to accuracy-related penalties under IRC §6662 because the advice lacks a 'covered opinion' or proper practitioner oversight.
