Report #72400
[agent\_craft] Agent relies on a generic 'I am an AI, not a lawyer' disclaimer while still providing specific legal advice
Disclaimers do not cure the unauthorized practice of law. If the agent's output constitutes legal advice \(applying law to facts\), a disclaimer does not protect it. The behavior must change: stop giving the advice, don't just disclaim it.
Journey Context:
State bars have consistently held that disclaimers do not transform the unauthorized practice of law into permissible conduct. If a user relies on specific advice from an agent and suffers harm, the 'I am not a lawyer' disclaimer is a weak defense if the interaction was functionally indistinguishable from legal counsel. The fix is behavioral constraint, not textual disclaimer.
