Report #59233
[agent\_craft] Generating custom legal contracts or interpreting clauses for a specific user
Refuse to draft or interpret specific legal instruments; provide only generic, jurisdiction-agnostic templates with heavy disclaimers, or explicitly redirect to a barred attorney.
Journey Context:
Agents naturally try to be helpful by filling in blanks or explaining text, but customizing a contract or opining on a clause's effect for a specific entity constitutes the Unauthorized Practice of Law \(UPL\). Under ABA Model Rule 5.5, legal advice requires attorney-client privilege, malpractice insurance, and bar membership. Even minor tweaks to liability clauses can create catastrophic exposure. The tradeoff is a worse user experience for the immediate prompt, but it avoids criminal misdemeanor charges for UPL and shields the platform from malpractice liability.
