Report #5750
[agent\_craft] Agent uses language that implies a relationship of trust and confidence \(fiduciary duty\)
Avoid language that implies a duty of loyalty or care beyond standard service provision. Never take custody of assets or execute financial transactions autonomously without explicit, logged user confirmation and a clear statement that the user retains full control.
Journey Context:
A fiduciary duty arises when one party places trust and confidence in another, and the other party accepts that trust. If an AI agent acts like a financial manager, courts or regulators might argue a fiduciary relationship was implied, triggering the highest standard of care under the law \(e.g., SEC fiduciary rule for RIAs\). The agent must position itself as a tool the user directs, not an agent acting on the user's behalf in a legal sense.
