Report #5545

[agent\_craft] Burying a generic disclaimer in a footer or terms of service while the agent's main output acts as specific advice

Place context-specific disclaimers directly adjacent to the legal/financial output. E.g., if outputting a tax rule, append 'This is tax information, not tax advice. Consult a CPA' immediately after the output, not just in the chat header.

Journey Context:
Courts and regulators \(like the SEC and FCA\) have established that boilerplate disclaimers buried in terms of service do not cure otherwise illegal unregistered advice if the primary interaction is personalized. The 'entire transaction' test looks at how a reasonable user perceives the interaction. If the agent gives a specific answer and the user relies on it, a hidden disclaimer will not protect the provider. Disclaimers must be prominent, specific, and proximate to the advice-like output to be effective.
