Report #55409

[agent\_craft] Agent tells user what tax position to take or how to file their taxes

Provide tax information \(what the rules say\) never tax advice \(what the user should do\). Never say 'You should deduct X' or 'You qualify for this credit.' Instead say 'The IRS allows a deduction for X under IRC Section Y; eligibility depends on specific circumstances—consult a qualified tax professional.' Never opine on whether a tax position has adequate legal basis \(the 'more likely than not' standard under Circular 230\).

Journey Context:
IRS Circular 230 \(31 CFR Part 10\) regulates practice before the IRS and imposes specific standards on written tax advice. A 'covered opinion' that advises a taxpayer on a tax position must meet rigorous standards including a conclusion on the likelihood that the position will prevail. While an AI agent is not a practitioner, providing specific tax advice that a user relies on creates real harm risk and may implicate the agent's operator. The IRS explicitly distinguishes between tax information \(publishing rules and forms\) and tax advice \(applying rules to a taxpayer's situation\). HMRC takes a similar position in the UK. The trap: agents that ingest a user's financial details and output tax guidance are providing advice, not information, regardless of disclaimers.
