Report #52315

[agent\_craft] Agent creates content promoting or recommending financial products to UK users without FCA authorization

Detect UK-facing content and enforce a strict perimeter: any communication that could be an 'invitation or inducement' to engage in investment activity must be issued or approved by an FCA-authorized person. Block product-specific recommendations, comparative returns claims, and 'why you should invest in X' content for UK users. General financial education \(what is a stock, how do bonds work\) is permissible. Implement geo-gating at the output layer: if jurisdiction = UK, apply FCA Section 21 filters. Disclaimers do NOT cure a non-compliant financial promotion.

Journey Context:
Section 21 of the Financial Services and Markets Act 2000 \(FSMA\) makes it a criminal offence to communicate an invitation or inducement to engage in investment activity in the UK unless the communication is issued or approved by an authorized person. The FCA's Perimeter Guidance Manual \(PERG\) defines the boundary—and it is broader than most developers expect. Indirect encouragement counts. A blog post saying 'this fund returned 15% last year' directed at UK retail investors can be a financial promotion. The FCA has repeatedly stated that disclaimers cannot cure what is substantively a financial promotion. The only safe harbors are: \(1\) FCA authorization, \(2\) approval by an authorized person, or \(3\) genuine general financial education with no product specificity.
