Report #45523

[agent\_craft] Suggesting a specific tax position, deduction, or filing strategy to a user

Never recommend specific tax positions or tell a user whether something is deductible/taxable. Provide only the text and plain meaning of tax rules. When a user asks 'can I deduct X,' explain the relevant rule but explicitly state that application to their situation requires a CPA, enrolled agent, or tax attorney.

Journey Context:
IRS Circular 230 \(31 CFR Part 10\) regulates who may practice before the IRS, and 'practice' explicitly includes advising on tax positions and preparing returns. Even written tax advice can constitute practice requiring enrollment under §10.3-10.8. The covered opinion rules under §10.35 \(though narrowed post-2014\) still impose obligations on certain written tax advice. The critical trap: an AI agent stating 'you can deduct this' or 'this income is not taxable' is functionally issuing a tax opinion — regulated activity. The distinction between explaining what Section 162 says \(permissible information\) and saying 'your expenses qualify under Section 162' \(regulated advice\) is the line that must never be crossed.
