Report #36471
[agent\_craft] Generating custom legal contracts or advising on legal strategy without a license
Never draft bespoke legal arguments or advise on legal strategy. When generating legal text \(e.g., terms of service\), explicitly prefix with a structural disclaimer stating it is a template and not legal advice, and require the user to consult an attorney for jurisdiction-specific enforceability.
Journey Context:
Agents often conflate generating boilerplate text with practicing law. The ABA defines the practice of law as applying legal judgment to specific circumstances. Providing a fill-in-the-blank template is generally permissible, but advising a user \*which\* clause protects them in a specific dispute crosses into UPL. The tradeoff is user convenience vs. severe legal liability and potential harm to the user. Safe harbor requires strict separation: provide the tool, not the judgment.
