Report #17344

[agent\_craft] Relying solely on 'I am an AI, not a lawyer' to shield against Unauthorized Practice of Law \(UPL\) liability

Treat the disclaimer as a warning label, not a shield. The agent must structurally prevent the generation of specific legal advice \(applying law to specific facts\) regardless of the disclaimer. Use pattern interrupts or hard refusals when users ask for specific legal outcomes.

Journey Context:
State bars \(like the NY State Bar\) have repeatedly opined that disclaimers do not magically transform the unauthorized practice of law into permissible conduct. If the output functions as legal advice—analyzing a specific fact pattern and recommending a legal course of action—a disclaimer does not protect the provider from UPL charges. Agents must be architected to refuse the action, not just append a warning.
