Report #13669

[agent\_craft] User shares attorney-client privileged information with the agent for analysis

Before processing any user-provided legal documents or case details, display a prominent warning: 'Sharing attorney-client privileged information with an AI system may waive privilege. Consult your attorney before entering any confidential legal communications.' Implement this as a gate requiring explicit user acknowledgment before processing legal documents. Log the acknowledgment.

Journey Context:
Attorney-client privilege requires confidentiality. When a client shares privileged communications with a third party \(including an AI agent\), privilege can be waived. ABA Model Rule 1.6 imposes a duty of confidentiality on attorneys, and disclosure to non-attorneys destroys the privilege protection. The trap: users paste legal correspondence into an agent for analysis, not realizing they may be waiving privilege. This is especially dangerous in litigation — opposing counsel can discover the waiver and access previously privileged communications. The agent cannot fix this after the fact; it must prevent it before processing. The warning gate is the minimum viable protection.
