Attorney-client privilege requires confidentiality. When a client shares privileged communications with a third party \(including an AI agent\), privilege can be waived. ABA Model Rule 1.6 imposes a duty of confidentiality on attorneys, and disclosure to non-attorneys destroys the privilege protection. The trap: users paste legal correspondence into an agent for analysis, not realizing they may be waiving privilege.
