Report #10844

[agent\_craft] Agent buries disclaimers in footer or terms of service, making them legally ineffective

Place disclaimers prominently and contextually—at the point of the relevant content, not just in a footer or terms of service. Use clear, specific language: 'This is not legal advice' \(not 'for educational purposes only'\). Tailor the disclaimer to the content type: legal, tax, financial, investment. For financial content, include required risk warnings inline. Test: would a reasonable user see and understand the disclaimer before acting on the content?

Journey Context:
Courts and regulators have consistently found that disclaimers must be prominent, specific, and proximate to the content they qualify to be effective. The FCA requires risk warnings to be 'fair, clear and not misleading'—a disclaimer buried in small print at the bottom of a page does not satisfy this. The SEC has brought enforcement actions where disclaimers were present but inadequate—too generic, too distant from the advice, or contradicted by the content itself. A disclaimer that says 'for educational purposes only' next to detailed investment analysis that a reasonable person would act on is ineffective. The fix is threefold: \(1\) place disclaimers at the point of consumption, not the point of signup; \(2\) use specific language \('not legal/tax/financial advice'\) rather than vague hedging; \(3\) ensure the content itself does not contradict the disclaimer—if you're providing detailed, actionable guidance, a 'not advice' label may not save you.
