Report #10672

[agent\_craft] Agent fails to maintain records of legal/financial information provided, creating compliance and defense gaps

Log all legal and financial information outputs with timestamps, the user query, the jurisdiction assumed, and the disclaimers provided. This creates an audit trail demonstrating the agent provided information, not advice. Include in the log: whether the user provided specific facts, whether the agent redirected to professional counsel, and the exact text of any disclaimers.

Journey Context:
SEC Rule 17a-4 requires broker-dealers to preserve records of communications for at least three years. FCA SYSC 9 requires similar record-keeping for authorized firms. While an AI agent providing general information may not be directly subject to these rules, maintaining records is critical for two reasons: \(1\) if the agent's activities are ever questioned by a regulator, the records demonstrate a pattern of providing information with appropriate caveats rather than advice; \(2\) if a user claims they relied on the agent's output as advice, the records show the disclaimers were provided and the user was redirected to professional counsel. The record should capture the full context: the user's query \(which may include specific facts\), the jurisdiction assumed, the general information provided, the disclaimers included, and any redirection to professional advice. This is not just compliance—it is the primary defense mechanism against claims that the agent provided regulated advice.
