Report #10287
[agent\_craft] Generating financial product content accessible to UK persons without FCA authorization
Any output referencing specific financial products, investment performance data, or benefits of a financial service must include FCA-required risk warnings and must not be communicated to UK persons unless the firm is FCA-authorized. Implement content classification to detect financial product references and geo-gate them for UK IP ranges. At minimum, append: 'This is not a recommendation to invest. Past performance is not indicative of future results. Investments can go down as well as up.'
Journey Context:
The FCA's financial promotions regime \(FSMA 2000 s.21\) makes it a criminal offense to communicate an invitation or inducement to engage in investment activity in the UK without authorization. This applies to AI-generated content. The trap: even seemingly neutral content like 'this stock has grown 200%' can be a financial promotion if it induces investment. Disclaimers alone are insufficient — the content itself must be approved by an FCA-authorized person. The only safe path for non-authorized firms is to ensure content never reaches UK persons or never constitutes a promotion. FCA PERG 8 provides detailed guidance on what counts as a financial promotion.
